Comment: There are two problems with this request, one practical and one policy. I don't have JSTOR access to that publication, so I can't see the image. That introduces the policy issue of WP:NFCC#2 and WP:NFCI. Since JSTOR is selling access to the image, I don't believe using it would meet the "respect for commercial opportunities" criterion. --AntiCompositeNumber (talk) 02:24, 6 January 2020 (UTC)
- @AntiCompositeNumber: With respect to the latter concern, neither JSTOR nor the Universities Art Association of Canada (UAAC; the publisher of RACAR) controls the rights to the image in question, to the best of my knowledge. Lawren Harris created the painting and the photograph is owned by Ron Vickers Ltd. That aside, it shouldn't affect the commercial opportunities of JSTOR or UAAC anyway as the primary content they are selling here is not the photographs (which they don't own) but rather the critical commentary on them and the research providing the historical context of them.
- If we were to accept the interpretation that the fact that it happens to have been found in a paywalled article in itself means it can't meet WP:NFCC#2, it would mean that any image that happens to appear in a book published for profit (or at least one still in print) – even if it had previously appeared elsewhere – wouldn't be allowable.
- Regarding the practical issue, I'm sure WikiProject Resource Exchange or one of the folks in Category:Wikipedians who have access to JSTOR could lend us a hand. 142.160.131.220 (talk) 23:29, 6 January 2020 (UTC)
- I've asked for additional input at WP:MCQ#Non-free use of an image from a paywalled journal. --AntiCompositeNumber (talk) 02:35, 12 January 2020 (UTC)
- I don't see an issue with NFCC#2,, but possibly so with NFCC#1. Were there really no depictions of him made pre-1923? If there were any, those would be PD, and so preferable to using something nonfree. Seraphimblade Talk to me 21:09, 15 January 2020 (UTC)
- I don't know of any, but you're right, Seraphimblade, that if such images were available WP:NFCC#1 could be a problem. 142.160.131.220 (talk) 01:26, 17 January 2020 (UTC)

Update: There appears to be a consensus at Wikipedia:Media copyright questions/Archive/2020/January § Non-free use of an image from a paywalled journal. that there is not a WP:NFCC#2 issue here. 207.161.86.162 (talk) 04:05, 19 February 2020 (UTC)

- The information linked to indicates that the State Library of North Carolina considers items in their collection to be public domain. It is not at all clear that this means all official works of the North Carolina state government are public domain. Comparing the terms of use for their official website, they grant permission for non-commercial reuse of state content, which is not compatible with the free license that Wikipedia is published under. GMGtalk 15:16, 26 February 2020 (UTC)
- Per GS132 [1]
- 132.1b: The public records and public information compiled by the agencies of North Carolina government or its subdivisions are the property of the people.
- 132.1a: "Public record" or "public records" shall mean all documents, papers, letters, maps, books, photographs, films, sound recordings, magnetic or other tapes, electronic data-processing records, artifacts, or other documentary material, regardless of physical form or characteristics, made or received pursuant to law or ordinance in connection with the transaction of public business by any agency of North Carolina government or its subdivisions. Agency of North Carolina government or its subdivisions shall mean and include every public office, public officer or official (State or local, elected or appointed), institution, board, commission, bureau, council, department, authority or other unit of government of the State or of any county, unit, special district or other political subdivision of government.
- I think this clearly indicates that it is public domain, since it is a public record work produced by an office of the government of North Carolina. The interpretation of the State Library of North Carolina is based on the State Law, and not about items in the collection of the State Library, but of all public records produced by the state government. -- 65.94.171.6 (talk) 05:42, 27 February 2020 (UTC)
- The requested image probably falls under the Edict of government exception to copyright. However, I don't believe it would be in-scope on Commons, as it is "contain[s] nothing educational other than raw text." --AntiCompositeNumber (talk) 20:01, 2 March 2020 (UTC)
- It's educational value is in being an example of how North Carolina produces honorary citizenship proclamations, and more generally, how a NC governor issues a proclamation. Its use for the Ayres article is historical and documentary -- 70.51.46.77 (talk) 21:02, 2 March 2020 (UTC)
- Still raw text. --AntiCompositeNumber (talk) 00:30, 3 March 2020 (UTC)
- It isn't just raw text, it contains graphics. And Commons already contains PDF documents. -- 70.51.47.127 (talk) 04:55, 3 March 2020 (UTC)
- Still raw text. --AntiCompositeNumber (talk) 00:30, 3 March 2020 (UTC)

Material currently on COMMONS:
Clearly "only raw text" is something that is hosted as imagery or PDF documetns on COMMONS. The honorary citizenship request here isn't just text, since it also contains graphical elements and formatting. -- 70.51.47.127 (talk) 04:49, 12 March 2020 (UTC)
